Christmas Vacation with Kids

Since the winter season is upon us, it is time to begin making plans for winter vacation. When parents are separated this can be difficult if they do not agree on the proposed schedule or travel plans for the holidays. If there is no agreement or court order parents should begin these discussions early. Parents should be ready to discuss:

  • the dates of the proposed trip;
  • where the child will be going on the proposed trip; and
  • how to contact the child while they are away.

If the relationship between the parents is tense the parties may wish to employ the use of a mediator or arbitrator. If the matter needs to be heard in court the parties will need to file an application. Parents should do this as early as possible as the court docket fills up quickly. Additionally, from December 19th to January 2nd the courts operate at a limited capacity and Judges do not sit on December 26th, 27th or January 2nd.
